Complaint Policy

1. Introduction: This document sets out our complaints policy. If you are a Lukado user, this Complaints Policy forms part of your contract with us.

2. Who we are and how to contact us: Lukado is run by Renáta Hálová, with registered office: Slovenská 2942/33, Karviná 733 01, ID number: 73958565, natural person doing business according to the Trade Act registered in the Trade Register, email: admin@lukado.cz

3. Interpretation: In this Complaints Policy, defined terms have the same meaning as in the Terms of Use for All Users. In addition, the term "working days" means any day that is not a Saturday, Sunday or public holiday in the Czech Republic.

4. Who can use this Complaints Policy? Whether or not you are a Lukado user, you can use this Complaints Policy to bring any complaint you have about Lukado to our attention.

5. How to file a complaint: If you have a complaint about Lukado (including any complaint about Content appearing on Lukado or user behavior), please send your complaint to admin@lukado.cz including your name, address, contact details, a description of your complaint, and if if your complaint is about content, please also send us the URL of the content.

6. How we will deal with complaints about illegal or objectionable content: Upon receipt of your complaint about illegal or objectionable content under section 5 above:

a) we will take such steps as we consider appropriate to investigate your complaint within a period that is reasonable for the nature of your complaint;

b) if we require further information or documents from you, we will contact you to inform you;

c) We will investigate your complaint in good faith within seven (7) business days;

d) if we believe that the content is illegal or objectionable, we will immediately remove such content and notify you of our decision by email;

e) if we believe that the content is not illegal or objectionable, we will notify you of our decision by email.

7. How We Will Handle Copyright Infringement Complaints: Copyright infringement complaints must be made in accordance with our following policies:

Notice of Claimed Infringement

If you believe that your work has been copied and posted on Lukado in a way that constitutes copyright infringement, please provide us with the following information:

a) electronic or physical signature of a person authorized to act on behalf of the owner of copyright or other intellectual property interests;


b) a description of the copyrighted work or other intellectual property that you claim has been infringed;


c) a description of where the material that you claim is infringing is located on the Site (including, if possible, the specific URLs associated with the material);


d) your address, telephone number and email address;

e) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and,


f) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on behalf of the copyright or intellectual property owner.< /p>

8. How We Will Handle Other Complaints: Upon receipt of additional complaints (including complaints related to other violations of our policies) pursuant to Section 5 above:

a) we will take such steps as we consider appropriate to investigate your complaint within a period that is reasonable for the nature of your complaint;

b) if we require further information or documents from you, we will contact you to inform you;

c) we will take such action in good faith as we consider appropriate to resolve the problem that gave rise to your complaint. If you have a complaint about Content appearing on Lukado and you are not satisfied that the Content violates our Terms of Use and Rules of Conduct, we will act quickly to remove such content;

d) we are not obliged to inform you about the outcome of your complaint.

9. Unauthorized or Abusive Complaints: If you are a Lukado user, you warrant (meaning you make a legally enforceable promise) that you will not make any complaint under this Complaint Policy that is wholly unjustified, abusive or made in bad faith. If we find that you have violated this warranty, we may suspend or terminate your user account.
